العلاقة بين المسؤولية المدنية والمسؤولية الإدارية: طرق التعويض عن الضرر في المسؤولية التقصيرية أنموذجًا

Abstract

The basis of civil liability, which balances private interests, differs from the basis of administrative liability, which aims to achieve public interest and ensure the smooth operation of public facilities. This raises the question of whether civil liability rules can be applied to disputes arising from administrative liability. Answering this requires understanding the relationship between civil and administrative liabilities. This research aims to clarify the relationship between these two liabilities, their points of agreement and disagreement, by studying the methods of compensation for damage in tort liability as a revealing model of this relationship, and then comparing it with Islamic jurisprudence. The research concluded that administrative courts apply civil rules to administrative compensation claims presented to them, to the extent that they do not conflict with the nature of administrative liability, while outlining the boundaries of that extent.

المستخلص

يختلف أساس المسؤولية المدنية القائمة على الموازنة بين المصالح الخاصة، عن أساس المسؤولية الإدارية القائمة على تحقيق المصلحة العامة وضمان انتظام حسن سير المرافق العامة، وإزاء ذلك يثور التساؤل عن إمكانية تطبيق قواعد المسؤولية المدنية على المنازعات الناشئة عن المسؤولية الإدارية، والإجابة عن ذلك تستلزم التعرف على العلاقة بين المسؤولية المدنية والمسؤولية الإدارية، ويهدف هذا البحث إلى بيان العلاقة بين هاتين المسؤوليتين ومواطن الاتفاق والاختلاف فيما بينها، من خلال دراسة جزئية طرق التعويض عن الضرر في المسؤولية التقصيرية باعتبارها أنموذجًا كاشفًا عن تلك العلاقة، ومن ثَم المقارنة بين ذلك وبين الفقه الإسلامي، وقد انتهى البحث إلى أن القضاء الإداري يطبق القواعد المدنية على دعاوى التعويض الإدارية المعروضة عليه، وذلك بالقدر الذي لا تتعارض به مع طبيعة المسؤولية الإدارية، مع بيان حدود ذلك القدر.
