أثر العرف في تقييد المطلق عند الشيخ العثيمين من خلال كتاب الشرح الممتع على زاد المستقنع

Abstract

This research aims to highlight the role of custom (ʿurf) and how it is used to restrict the absolute (muṭlaq) according to Sheikh Ibn ʿUthaymīn, particularly through his book Al-Sharḥ Al-Mumtiʿ. The study also examines his other works and whether custom played a pivotal role in his interpretation of texts, as well as how he addressed the temporal and spatial changes of customs through a close reading of Al-Sharḥ Al-Mumtiʿ and his other writings. The research clarifies the significance of custom for Sheikh Ibn ʿUthaymīn, the conditions for applying custom, and the criteria for restricting the absolute through custom in practical jurisprudential applications. It occasionally presents the opinions of the four major jurists in relation to statements made by Sheikh Ibn ʿUthaymīn regarding the principles and indications for using custom, demonstrating the correctness of his reasoning. One of the key findings of the research is that custom is a means of restricting absolutes, defining the scope of general rulings, and has a significant and strong influence on fatwas. The recognized custom in this context has specific limitations and criteria. The role of custom in restricting the absolute reflects one aspect of the flexibility of Islamic law in addressing reality and social changes. Researchers should give significant attention to studying the impact of custom in the jurisprudence of Sheikh Ibn ʿUthaymīn through a comprehensive analysis of his works and the jurisprudential and foundational principles he discussed concerning custom.

المستخلص

يهدف البحث إلى بيان إبراز دور العرف وكيفية الاستئناس به لتقييد المطلق عند الشيخ ابن عثيمين من خلال كتابه الشرع الممتع خصوصا، من خلال التعريج أيضا على باقي أقواله في مؤلفاته وهل كان عرف عاملا محوريا في تفسيره للنصوص وكيف تعامل مع المتغيرات الزمنية والمكانية للعرف من خلال القراءة في كتابه الشرح الممتع على وجه الخصوص وبقية مؤلفاته عموما والبحث يبين مكانة العرف عند الشيخ وشروط العمل بالعرف وشروط تقييد المطلق بالعرف تطبيقات فقهية، ويعرض البحث أقوال الفقهاء الأربعة أحيانا في قول ذكره الشيخ في أحد ضوابط ودلالات استخدام العرف مبينا وجه صحة وجهة الشيخ في الاستدلال، ومن أبرز النتائج التي توصل إليها البحث أن العرف من وسائل تقييد المطلقات وأنه يحدد نطاق الأحكام العامة وأنه له تأثيره الكبير والقوي في الفتاوى، والعرف المعتبر في ذلك له قيود وضوابط، ويمثل العرف في تقييد المطلق أحد أوجه مرونة الشريعة في التعامل مع الواقع والتغيرات الاجتماعية، وعلى الباحثين أن يولوا أهمية كبرى دراسة أثر العرف في فقه الشيخ ابن عثيمين من خلال تحليل شامل لمؤلفاته، ودراسة القواعد الفقهية والأصولية التي تناول فيها الشيخ العرف.
