أثر نشوز الحامل على النفقة دراسة فقهية مقارنة وتطبيقها على نظام الأحوال الشخصية السعودي
Abstract
This study focuses on disobedience of the pregnant wife (the wife's violation of marital duties) and its impact on her alimony. It is essential to Sharia's objectives, both in terms of protecting the self and money, which can be seen in its application to the personal status system in Saudi Arabia. Specifically, the study aims to examine the relationship between the pregnant woman and her infant, examine disobedience’s impact on pregnant women entitled to pregnancy alimony, and apply the issue to Saudi Arabia's personal status system. Several results were found in this study, including: the emergence of the impact of the two states of pregnancy and disobedience on the wife's alimony, in terms of retention or termination, and the reasons for the disagreement on this issue, as well as the role of the father in carrying that burden and the relationship between alimony and the mother and the infant. It also found the application of study of pregnancy and disobedience, as well as what pertains to them, ranging from proving the right to alimony or its lapse, to advancing or delaying it, and suing the court for the right to return when the father refuses to provide alimony.
المستخلص
الموضوع الذي تدور حوله الدراسة هو: نشوز الزوجة الحامل وأثر ذلك على نفقتها، وهي من المسائل الضرورية التي تؤثر في مقاصد الشريعة من حماية للنفس وللمال، وتظهر أهميتها من خلال تطبيقاتها في نظام الأحوال الشخصية في المملكة العربية السعودية.
وتهدف الدراسة إلى: تحرير متعلق النفقة بين الحامل وبين جنينها، ودراسة أثر النشوز على مستحقي نفقة الحمل، وربط المسألة بالواقع، وتطبيقها على نظام الأحوال الشخصية في المملكة العربية السعودية، في ضوء المنهج الاستقرائي التحليلي للبحوث العلمية. وكان من أبرز النتائج:
ظهور أثر حالتي الحمل والنشوز على نفقة الزوجة، في الإيجاب أو الإسقاط، وثمرة الخلاف في المسائل المتعلقة بهذا الموضوع، وتعلق النفقة بالأم أو بالجنين ودور الأب في تحمل ذلك، إضافة إلى الدراسة التطبيقية لمسائل الحمل والنشوز، وما يتعلق بها من إثبات حق النفقة أو سقوطها، أو تقديمها أو تأخيرها، والمطالبة بحق الرجوع عند امتناع الأب عن النفقة، والترافع للقضاء بذلك.
